Maui Jim USA, Inc., together with its affiliates, provides its products for purchase under these Terms of Sale. By placing an order, you are agreeing to be bound by these terms, which constitute a legal agreement. You confirm that you have the authority, legal capacity, and appropriate age in your jurisdiction to enter into this agreement and purchase the products. If you do not accept these terms, you should refrain from placing an order or retaining any purchased products. Maui Jim may update these terms at any time, and the version in effect at the time of your order governs the transaction. Any disclaimers, limitations, or exclusions stated in these terms may not apply if prohibited by local law. Your purchase is also subject to Maui Jim’s general Terms and Conditions and Privacy Policy.

Orders for products from the Maui Jim website are accepted at our discretion. Payment is captured at the time of the order, and an additional authorization may be obtained from your payment provider to confirm available funds. Maui Jim reserves the right to cancel or refuse any order prior to shipment, and may contact you if further information is required. By providing payment details, you authorize us to charge the total order amount, including applicable taxes and fees. Orders with invalid or unacceptable payment methods may be suspended or cancelled, and any issues must be resolved to complete the purchase. Payment information can be updated through customer service.

Product availability is subject to change, and Maui Jim may limit quantities or discontinue items without notice. Prices can change at any time but will not affect orders already placed. Sales tax may be applied in accordance with law. Gift cards and promotional cards are governed by specific terms and may expire or become inactive after use or upon reaching the expiration date. Products purchased from the website are intended for end users only, with ownership transferring to the buyer upon delivery to the carrier.

Shipping methods and costs are outlined on the website, and estimated delivery dates are not guaranteed. Returns of refused deliveries may take up to 45 days to process. Compliance with applicable laws for product shipment is the buyer’s responsibility. Maui Jim offers a two-year limited warranty for frames and lenses against manufacturer defects, covering replacement or repair at our discretion. Damage caused by misuse, alterations, or normal wear and tear is not covered. Warranty claims require submission of the defective product and proof of purchase, and a processing fee may apply. Repairs outside warranty coverage may be offered at our discretion, with cost estimates provided upon request.

Returns of products purchased directly from Maui Jim must occur within 30 days with proof of purchase. Liability is limited to the maximum extent allowed by law, excluding indirect, incidental, or consequential damages. Total liability is capped at the amount paid for the product. Breaches of these terms may result in injunctive relief. These terms are governed by Illinois law, and disputes fall under the jurisdiction of courts in Peoria, Illinois. Maui Jim is not liable for delays caused by events beyond its control, and reserves the right to refuse service to any person. If any provision is unenforceable, the remaining terms remain effective. Employees cannot modify terms on behalf of the company, and Maui Jim may assign rights without consent. Special provisions apply to New Jersey residents under state law.
